HOLISTIC ESCAPES — BOOKING TERMS & CONDITIONS

1. ABOUT THESE TERMS
These Booking Terms and Conditions ("Terms") apply to all retreat bookings made with Holistic Escapes ("we", "us", "our"), operated by Courtney Chambers. By paying a deposit or making any payment toward a Holistic Escapes retreat, you ("the guest") confirm that you have read, understood and agreed to these Terms in full.
These Terms form a binding agreement between you and Holistic Escapes. Please read them carefully before booking.
2. BOOKING & DEPOSIT
2.1 To secure your space on a Holistic Escapes retreat, a non-refundable deposit of $500 USD per person per retreat is required at the time of booking.
2.2 Your booking is not confirmed until your deposit has been received and you have received written confirmation from Holistic Escapes.
2.3 Spaces are strictly limited. Paying your deposit does not guarantee your preferred villa category or room type — these are allocated on a first come, first served basis and confirmed in writing at the time of booking.
2.4 By paying your deposit you confirm that you are 18 years of age or older, that you have read and accepted these Terms, and that you are booking on behalf of yourself and any guests included in your booking.
3. BALANCE PAYMENTS
3.1 The remaining balance of your retreat fee is due no later than 90 days prior to the retreat start date.
3.2 You will receive a payment reminder from Holistic Escapes prior to your balance due date.
3.3 If full payment is not received by the balance due date, Holistic Escapes reserves the right to cancel your booking and retain all payments made to date, including your deposit.
3.4 For bookings made within 90 days of the retreat start date, full payment is required at the time of booking.

4. CANCELLATION BY THE GUEST
4.1 All payments made to Holistic Escapes — including deposits and balance payments — are strictly non-refundable and non-transferable, regardless of the reason for cancellation.
4.2 This applies to all circumstances including but not limited to personal illness or injury, family emergencies, work commitments, flight cancellations or delays, visa issues, relationship breakdown, change of mind or any other personal circumstance.
4.3 Cancellation must be notified in writing to connect@holisticescapes.com.au. The cancellation date is the date on which written notification is received by Holistic Escapes.
4.4 No refunds or credits will be issued for:
Failure to attend any part of the retreat program
Early departure from the retreat
Unused services, sessions or inclusions
Arriving late to the retreat
4.5 In exceptional circumstances and entirely at the discretion of Holistic Escapes, a credit toward a future retreat may be considered. This is not guaranteed and will be assessed on a case by case basis. No cash refund will be provided under any circumstances.
4.6 This is why travel insurance is mandatory. A comprehensive travel insurance policy — purchased at the time of booking — will cover you financially in the event you are unable to attend due to illness, injury, family emergency or other covered circumstances. See Section 8.
5. CANCELLATION OR CHANGES BY HOLISTIC ESCAPES
5.1 Holistic Escapes reserves the right to cancel, postpone or modify any retreat at any time. In the event that Holistic Escapes cancels a retreat for reasons other than Force Majeure (see Section 6), the following will apply:
If cancelled more than 90 days before the retreat start date: guests will receive a full credit of all payments made, transferable to any future Holistic Escapes retreat within 24 months
If cancelled within 90 days of the retreat start date: guests will receive a full refund of all payments made to Holistic Escapes (excluding any third party costs already incurred)
Holistic Escapes will not be liable for any additional costs incurred by guests including but not limited to flights, travel insurance, visas, accommodation booked independently or any other associated travel costs
5.2 Holistic Escapes reserves the right to make changes to the retreat itinerary, accommodation, venues, schedule or activities at any time. Where changes are significant, guests will be notified as soon as practicable. Minor changes to the itinerary do not constitute grounds for cancellation or refund.
5.3 If minimum guest numbers are not reached, Holistic Escapes reserves the right to cancel the retreat. Guests will be notified no later than 60 days prior to departure and offered a full credit or refund of all payments made to Holistic Escapes.
5.4 Holistic Escapes strongly recommends that guests do not book non-refundable flights until minimum numbers have been confirmed. We will communicate confirmation of minimum numbers no later than 60 days prior to departure.
6. FORCE MAJEURE
6.1 Definition. For the purposes of these Terms, a Force Majeure Event means any event or circumstance beyond the reasonable control of Holistic Escapes that prevents or significantly impairs the ability to operate the retreat as planned, including but not limited to:
Acts of God including earthquakes, floods, tsunamis, cyclones, volcanic eruptions, landslides, lightning strikes or other natural disasters
Epidemic, pandemic or public health emergency declared by a government or international health authority
Government-imposed travel restrictions, border closures, mandatory quarantine requirements or health advisories that prevent travel to or from the retreat destination
War, civil war, terrorism, civil unrest, riot, insurrection or threat thereof
Strikes, industrial action or labour disputes affecting essential services
Failure of essential infrastructure including power, water or communications
Any other event that makes it impossible, unsafe or unlawful to operate the retreat
6.2 Effect of Force Majeure. In the event of a Force Majeure Event:
Holistic Escapes may cancel, postpone or modify the retreat without liability to guests beyond what is expressly stated in these Terms
Holistic Escapes will not be liable for any loss, damage, cost or expense incurred by guests as a result of the Force Majeure Event
Holistic Escapes will use reasonable endeavours to notify guests as soon as practicable after becoming aware of the Force Majeure Event
6.3 Guest remedies in a Force Majeure cancellation:
Where the retreat is cancelled due to a Force Majeure Event, guests will receive a credit equal to all payments made to Holistic Escapes, transferable to any future Holistic Escapes retreat within 24 months of the original retreat date
No cash refund will be issued in the event of a Force Majeure cancellation
Holistic Escapes will not be liable for any costs beyond the amounts paid directly to Holistic Escapes, including flights, visas, travel insurance, accommodation or any other independently arranged travel costs
Guests are strongly advised to ensure their travel insurance policy covers Force Majeure cancellations, pandemics and government-imposed travel restrictions
7. CHANGES TO BOOKING BY THE GUEST
7.1 Requests to change your retreat dates, villa category or room type must be made in writing to connect@holisticescapes.com.au and are subject to availability.
7.2 Changes are not guaranteed and will be considered at the sole discretion of Holistic Escapes.
7.3 Any changes that result in an increase in the retreat price must be paid in full at the time the change is confirmed.
7.4 Name transfers are not permitted. Your booking is personal to you and cannot be transferred to another person.
8. TRAVEL INSURANCE — MANDATORY
8.1 Comprehensive travel insurance is mandatory for all guests and must be purchased at or before the time of booking.
8.2 Your policy must cover as a minimum:
Trip cancellation and curtailment for any reason
Medical expenses and emergency evacuation
Travel delays and missed departures
Baggage loss and delay
Epidemic, pandemic or public health emergency related cancellation and disruption
Force Majeure events including government travel restrictions
Any activities undertaken during the retreat including water sports and physical activity
8.3 Proof of travel insurance may be requested by Holistic Escapes prior to the retreat start date.
8.4 Holistic Escapes strongly recommends purchasing your policy at the time of booking — not closer to departure — so that you are covered from the moment you reserve your space.
8.5 Holistic Escapes is not responsible for advising on, arranging or reviewing travel insurance policies. It is your sole responsibility to ensure your policy is adequate for your needs.
8.6 Failure to hold adequate travel insurance does not entitle you to any refund, credit or compensation from Holistic Escapes.
9. HEALTH & FITNESS
9.1 All guests are responsible for ensuring they are physically and mentally fit to participate in the retreat program.
9.2 You must disclose any medical conditions, injuries, disabilities, pregnancy or other physical or mental health considerations that may affect your participation at the time of booking. This includes but is not limited to chronic illness, recent surgery, cardiovascular conditions, mental health conditions and mobility limitations.
9.3 Holistic Escapes reserves the right to exclude any guest from any activity or session at any time where participation may present a risk to the health and safety of that guest or other participants.
9.4 Holistic Escapes is not a medical provider. Nothing in the retreat program constitutes medical advice, diagnosis or treatment. Guests should consult their own medical practitioner before attending any retreat.
9.5 Holistic Escapes accepts no liability for any injury, illness or health event arising during or as a result of participation in the retreat program.
10. GUEST CONDUCT
10.1 All guests are expected to behave in a respectful, considerate and lawful manner throughout the retreat.
10.2 Holistic Escapes reserves the right to remove any guest from the retreat at any time if their behaviour is deemed disruptive, unsafe, offensive or harmful to other guests, staff or the retreat experience. In such circumstances no refund will be provided.
10.3 Guests are responsible for any damage caused to retreat accommodation, facilities or equipment during their stay.
11. LIABILITY
11.1 To the maximum extent permitted by law, Holistic Escapes excludes all liability for any loss, damage, injury, illness, cost or expense suffered or incurred by any guest in connection with a Holistic Escapes retreat.
11.2 Holistic Escapes is not liable for any loss or damage arising from the acts or omissions of third party suppliers including but not limited to hotels, transport providers, activity operators or other service providers.
11.3 Holistic Escapes is not liable for any indirect, consequential or special loss including but not limited to loss of enjoyment, loss of income or loss of opportunity.
11.4 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.
12. PRIVACY
12.1 By making a booking with Holistic Escapes you consent to the collection, storage and use of your personal information for the purpose of managing your booking and communicating with you about your retreat.
12.2 Your personal information will not be sold or shared with third parties except where required to deliver the retreat program (e.g. accommodation providers, transport operators).

13. GENERAL
13.1 These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
13.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
13.3 Holistic Escapes reserves the right to update these Terms at any time. The Terms in effect at the time of your booking will apply to your booking.
13.4 These Terms constitute the entire agreement between you and Holistic Escapes in respect of your retreat booking.
By paying your deposit you confirm that you have read, understood and agreed to these Booking Terms and Conditions in full.
